AI logos and the law
Trademarking an AI-generated logo is usually fine.
Owning it is the real problem.
The actual legal difference between trademark and copyright, and what it means for a logo an AI made.
Everyone worries about the wrong law. The trademark question is usually fine. The copyright question is where an AI-generated logo actually falls apart.
This is general information about how trademark and copyright law typically apply, not legal advice, talk to an IP attorney before making a filing decision.
| Trademark | Copyright | |
|---|---|---|
| Protects | Your brand identifier | The artwork itself |
| What matters | Distinctiveness, use in commerce | Real human creative authorship |
| A purely AI-made logo | Generally registrable | Generally not protectable |
Trademark: usually not the problem
Trademark law cares about two things, is the mark distinctive, and are you using it in commerce. It doesn't ask who, or what, made it. The USPTO doesn't block AI-generated marks outright, plenty get registered. If your logo works as a source identifier and you're actually using it to sell something, trademarking it is usually possible.
Copyright: the actual problem
Copyright is different. The US Copyright Office requires real human authorship, a work made entirely by an AI, with no meaningful human creative control over the result, doesn't qualify. That's been tested up to the Supreme Court, which declined to disturb it. Practically: if a human didn't meaningfully shape the design, nobody holds exclusive rights to that image. Not you, not the AI, no one.
What that actually means for you
You can still register a trademark on an AI-generated mark. What you can't do is stop someone else from using the same or a very similar image, because you never owned the artwork itself. And if the model generated something too close to an existing copyrighted design, the exposure runs the other way, you could be the one infringing.
If you're weighing AI vs. a designer more broadly
This page covers the legal side. For the fuller picture, speed, cost, quality, and whether it's worth redoing later, see AI logo generator vs. a real designer. And if the legal risk alone isn't the deciding factor, here's how to know when the timing is actually right.
Two more things worth knowing
Distinctiveness gets harder in practice than on paper. Everyone's prompting the same handful of tools with similar inputs, so AI logos tend to converge. A mark too close to someone else's, AI-made or not, can get refused or challenged regardless of the copyright question.
Check the platform's terms before you build a brand on one. Some free tools keep rights to what they generate or restrict commercial use. "The output is yours" in a terms of service isn't the same as owning the copyright.
The simple version
You can probably trademark it. You probably don't own it. A mark that isn't clearly yours isn't something to build years of brand equity on. If you want something that's actually yours from the start, see what a proper brand identity package includes, or start now.

Can I register a trademark on a logo an AI generated for me?
Generally yes. The USPTO looks at distinctiveness and use in commerce, not who made the design. Just don't expect to also own the artwork itself under copyright.
If I can't copyright it, can someone else just use my AI-generated logo?
Legally, there's a real risk of that, since nobody holds exclusive rights to a purely AI-made image. A registered trademark still protects your right to use it as your brand identifier, it just doesn't stop someone from copying the artwork itself.
Does hiring a designer to touch up an AI logo fix the copyright problem?
It can help. Meaningful human creative changes can bring a work back under copyright protection, but there's no clean line for how much is enough. Starting from a human-made original avoids the question entirely.
